Chinese Christian files motion to dismiss judge

ChinaAid reports that the wife of a Chinese house church leader sentenced to prison camp last month has filed a motion to dismiss the chief justice of a district court for refusing to consider her husband’s administrative lawsuit. The motion claims that the court committed three legal errors in its handling of the case.
Tong Houyong and two other Christian men, Xie Zhenqi and Shu Wenxiang, were sentenced to one year of “re-education through labour” for organising an illegal gathering of Christians in a private residence. About 20 other Christians arrested at the same time received lighter sentences.
The motion to dismiss the chief justice is based on three points: 1) The court had no legal basis to refuse the case, 2) The court violated the law by refusing to provide receipts documenting that the court received the lawsuit, and 3) The court violated legal procedure by causing a long delay without making a decision on the case.
The motion for dismissal also states that “Chuanhui District People’s Court blatantly violated the law…As the person directly responsible for matters like this, the chief justice of Chuanhui District People’s Court caused delays in my lawsuit with various excuses… I hereby request the relevant authorities dismiss the chief justice of Chuanhui District People’s Court.”

I wonder if this case came up at the recent secret meeting between Chinese officials and leaders of the banned house church movement.
