House arrest recommended for mother guilty of infanticide

The crown and defence have agreed that Angela Kuehl, 27, of Ottawa should be sentenced to one year of house arrest and two years of probation for smothering her newborn infant and hiding his corpse in the trash. The judge did not immediately agree with their recommendation and will render a sentence in August.
She killed her baby because her boyfriend didn’t want children.
After hearing Crown prosecutor Louise Dupont read the facts in the case, Justice Lynn Ratushny delayed Kuehl’s expected sentencing until August to further study the evidence.

Two police officers searched for two days through a garbage truck before they found the child wrapped in a towel with a plastic bag tied tightly around its head.Dupont said Kuehl repeatedly lied to police and doctors, insisting that the child had been stillborn and deformed.
In fact, the child weighed more than seven pounds and was 21 inches tall.
Compare that with the recent case of Penny Boudreau of Bridgewater, Nova Scotia, who was sentenced to life imprisonment for killing her daughter. Ms Boudreau’s motive was the same as Ms Kuehl’s: She wanted to maintain her relationship with a man who didn’t want children.
The crucial difference seems to be that Boudreau’s daughter Karissa was 12 years old. If Kuehl is allowed to walk away with the recommended house arrest and probation, aren’t our courts saying that mothers of newborns are not responsible for their actions?
